California Judicial Branch watchdogs allege that Supreme Court Chief Justice Tani Cantil-Sakauye is responsible for a court corruption epidemic sweeping the state.

Case Fixing Scandal, Racketeering Scheme, Whistleblower Retaliation Attributed to Leadership of Judicial Council Chair Tani Cantil-Sakauye

Sacramento Family Court News has published an exhaustive, investigative report alleging that a criminal organization involving judges and local attorneys operates within the Sacramento County family law court system. The report is the latest allegation that corruption has reached epidemic levels in California courts.

Court whistleblowers and watchdogs charge that California Judicial Council Chair Tani Cantil-Sakauye has used her position to quash investigations into the alleged criminal conduct of her former coworkers in Sacramento Superior Court, and the adjacent, and troubled 3rd District Court of Appeal.

Government Whistleblower Leaks Courtroom Security Video of Illegal Arrest of Disabled, Unrepresented "Pro Per" Parent

Judge Matthew Gary Abuse of Authority Alleged

A startling courthouse security video leaked by a government whistleblower records the illegal 2009 assault and arrest of indigent, disabled pro per litigant and family court reform activist Robert Saunders. During a March 9, 2009 court hearing, Judge Matthew Gary ordered the self-represented Saunders arrested and jailed for contempt of court.

Two outside, independent judges who later reviewed the incident determined that both the contempt charge and arrest were illegal.

One of the two reviewing judges also issued an order removing Gary from the case for bias and violating state contempt law. The new video leak appears to reinforce the review findings, showing Saunders sitting passively at the courtroom counsel table until a painful "control hold" is applied to his arm by a deputy sheriff.

When Saunders reacts to the pain, a wrestling match ensues until additional deputies arrive to subdue and apply handcuffs to the illegally arrested victim. The pro per is then shuffled off to the county jail through a rear exit in the courtroom.

Saunders is 5' 8" tall, weighs 162 pounds, relies on a cane to walk, and, at the time of the arrest, was 57-years-old, according to the police report from the incident.

Systemic Temporary Judge Conflict of Interest Disclosure Law Violations Confirmed by Supreme Court Committee

FBI Sacramento Division Special Agent in Charge Monica Miller Federal Bureau of Investigation
The Supreme Court Committee on Judicial Ethics Opinions has issued an important "Formal Opinion" confirming that conflict of interest disclosures by judges be made in writing when no court reporter is present.

Presiding Judge Robert Hight Responsible for Legal Error Tainting Hundreds of Cases

An attorney and Sacramento Family Court News reader provided the California Supreme Court Committee on Judicial Ethics Opinions Formal Opinion embedded at the end of this article. The opinion provides an additional legal reference confirming that family court judges must disclose potential conflicts of interest on the record.

At court hearings where no court reporter is present, the disclosure must be in writing, according to the CJEO. A SFCN investigation last year revealed that family court judges were not in compliance with conflict of interest disclosure laws. Judges continue to ignore conflict laws, according to recent case audits conducted by SFCN.

Obstruction of Justice Crimes Alleged Against Family Court Temporary Judge and Sacramento County Bar Officer Paula Salinger

California Supreme Court, Justice Leondra R Kruger, Justice Mariano Florentino Cuellar, Justice Goodwin H Liu, Justice Carol A Corrigan, Justice Ming W Chin, Justice Kathryn M Werdegar, Justice Tani Gorre Cantil-Sakauye, Supreme Court of California
Woodruff, O'Hair, Posner and Salinger partner Paula Salinger allegedly engaged in obstruction of justice crimes against an indigent, disabled domestic violence victim without an attorney. Oversight authorities, including Sacramento County District Attorney Jan Scully and the State Bar have declined to investigate the allegations.

Whistleblower leaked records from a Sacramento Family Court case - embedded at the bottom of this post - indicate that criminal acts were committed by family law attorney and temporary judge Paula Salinger against an indigent, unrepresented, pro per family court party.

The pro per was a victim and witness in a family court criminal contempt case filed against a Salinger client, and the pro per also is disabled with a cognitive disability, and is a domestic violence victim, according to court records.

Family court reform advocates say the case is another example of the complete lack of oversight and accountability of attorneys who engage in egregious misconduct against disadvantaged, pro per litigants who can't afford legal representation.

Judge Matthew Gary Misconduct Victim Describes Emotional Trauma of Illegal "No Contact" Child Custody Order

Family Court Victim Describes Trauma of Illegal Child Custody Order and Mistreatment of Unrepresented Parents by Judge and Court Employees

News Analysis and Opinion by PelicanBriefed

In this exclusive, Sacramento Family Court News interview, indigent, disabled family court victim Susan Ferris describes in her own words the trauma of being separated from her daughter because of an illegal "no contact" child custody order issued against her by controversial, volatile, Judge Matthew Gary. Ferris also explains the frustration of having to represent herself because she can't afford an attorney, going up against an experienced family law attorney in court, and having her attempt to file an appeal blocked by court employees

The interview was recorded between Thanksgiving and Christmas, on December 16, 2012. In the right foreground of the video is the Christmas village Ferris and her daughter Megan together would set up each holiday season. Ferris describes the excruciating hardship of having to go through the holidays without her daughter. Megan and her mom were torn apart by six words scrawled on a yellow minute order: "No contact w/child in any manner." Judge Thadd Blizzard Controversy: Court Order Authorizes Criminal Child Abduction for Judge Pro Tem Attorney Richard Sokol - Whistleblower Leak

A whistleblower leaked court reporter transcript records Judge Thadd Blizzard approving a
criminal child abduction by a client of part-time judge divorce lawyer Richard Sokol.

Tuesday Document Dump

A whistleblower leaked court reporter transcript obtained by Sacramento Family Court News reveals that Judge Thadd Blizzard last November retroactively endorsed an unlawful out-of-state "move away" and child abduction at the request of local judge pro tem attorney Richard Sokol.  The transcript is embedded at the end of this article.

The unprecedented ruling went against San Francisco attorney Archibald Cunningham, who the transcript reflects was dumbfounded by the decision.

The bizarre chain-of-events began after Cunningham's disabled client, Robert Saunders, filed paperwork seeking child visitation under an existing temporary custody order. After the visitation paperwork was lodged, Sokol's client, April Berger, abruptly moved to Hawaii with the parents' twin daughters without the permission of the court.

A court reporter transcript obtained by Sacramento Family Court News records divorce attorney Richard Sokol making demonstrably false statements at a court hearing before Judge Thadd Blizzard

Sokol's apparent motive was to demonize and discredit the opposing party in a family court child custody dispute. Sokol is a Sacramento County Superior Court sworn temporary judge and Sacramento Bar Association Family Law Section member.

Sokol is caught on court reporter transcript giving a false account of a prior court hearing before controversial Judge Matthew Gary in the same case. At the previous hearing, Gary had Robert Saunders, the disabled, unrepresented pro per opposing party, arrested and jailed for contempt of court.

Saunders also was charged with resisting arrest by Gary's courtroom bailiff, Sacramento County Sheriff's Department Deputy J. Strong. As Sacramento Family Court News reported in 2012, two outside, independent judges who later reviewed the incident found that Gary was at fault, and cleared Saunders of all charges.

Gary was involuntarily disqualified, and banned from hearing further proceedings in the case by San Joaquin Superior Court Judge Xapuri Villapudua

One form of historical revisionism is the “illigitmate distortion of the historical record such that certain events appear in a more or less favorable light,” according to Wikipedia. The distortion of history to deny historical crimes is sometimes called negationism

Historical revisionism is often associated with after-the-fact justifications for, or denial of war crimes, such as the Holocaust and the Armenian Genocide

Some countries have laws making it a crime to disseminate revisionist material, such as Holocaust denial propaganda. Revisionist tactics include deception, denial and trivialization

A court reporter transcript obtained by Sacramento Family Court News shows that the same tactics have recently been used in Sacramento Family Court by judge pro tem attorneys Richard Sokol and Elaine Van Beveren. Van Beveren currently also is an officer of the Sacramento County Bar Association Family Law Executive Committee

The transcript records Sokol and Van Beveren disseminating subtle and overt falsehoods, deceptions, denials and trivializations about the unlawful 2009 assault and arrest of indigent, disabled litigant and family court watchdog Robert Saunders, in the courtroom of Judge Matthew Gary. Both Sokol and Van Beveren were eyewitnesses to the incident.

In April, 2012 SFCN published an in-depth, investigative report on the debacle and subsequent events, including the vindication of Saunders by two outside, independent judges. Click here to read our report.

Vance Raye and Peter J. McBrien were the
architects of the current family court system.

In 1991, as a superior court judge, current 3rd District Court of Appeal Presiding Justice Vance Raye partnered with controversial family court Judge Peter J. McBrien and attorneys from the Sacramento County Bar Association Family Law Section in establishing the current, dysfunctional Sacramento Family Court system, according to the sworn testimony of McBrien at his 2009 judicial misconduct trial before the Commission on Judicial Performance

Behind closed doors and under oath, the judge provided explicit details about the 1991 origins of the present-day family court structure.

In essence, McBrien and Raye agreed to effectively privatize public court operations to the specifications of private-sector attorneys in exchange for not having to run the court's settlement conference program. The SCBA Family Law Section agreed to run the settlement program provided they were given effective control over most court policies and procedures, including local court rules.

As a result, the public court system was restructured to the specifications of local, private-sector attorneys, according to McBrien's testimony. To view McBrien's detailed description of the collusive public-private collaboration, posted online exclusively by SFCN, click here. To view an example of the same, current day collusion, click here

The 1991 restructuring plan began with a road trip suggested by the family law bar:
"[T]he family law bar, and it was a fairly strong bar here in Sacramento, initiated the concept of a trip to Orange County and San Diego County to pick up some ideas about how their courts were structured. And myself and Judge Ridgeway and two family law attorneys made that trip and came back with various ideas of how to restructure the system," McBrien told the CJP. Click here to view.

Sacramento Family Court judges and local, Sacramento Bar
Association attorneys openly acknowledge their close relationship.
But before his sworn 2009 CJP testimony, McBrien gave the public a different account of the road trip and who restructured the family court system in 1991. As reported by the Daily Journal legal newspaper, McBrien dishonestly implied that the new system was conceived and implemented by judges alone after they made a county-paid "statewide tour" of family law courts.

The judge omitted from the story the fact that the trip was initiated by the family law bar, and included two private-sector family law attorneys who took the county-paid tour with McBrien and the late Judge William Ridgeway. As the Daily Journal reported
"Around 1990, McBrien and a few other Sacramento judges went on a statewide tour of family law courts. At the time there were continual postponements of trials.
'This is how we came up with the system today,' McBrien said. 'It was probably the best trip Sacramento County ever paid for.'
The judges changed the local system so that family law judges presided over both law and motion matters and trials, which used to be sent to a master calendar department and competed with criminal trials for scheduling.
'Now, if you're ready and unable to settle, chances are 99.9 percent that you are going out [to trial] the first time,' McBrien said. 'A lot of that is attributable to the willingness of the Sacramento bar to work as settlement counselors.'" Click here to view the Daily Journal report.

Sacramento Family Court News often receives emails from readers asking for help with allegedly unethical attorneys who, for example, tell lies in court or in court filings. As a nonprofit news organization, SFCN does not provide legal advice or assistance with making complaints against attorneys or judges. Click here for the State Bar of California webpage about making a complaint against an attorney. Click here for the State Bar attorney ethics information webpage.

For more information on attorney ethics, visit our new attorney misconduct page. The page contains information on basic attorney ethical standards in California, and legal references and authorities about attorney misconduct. For example, many attorneys and family court litigants are unaware that attorneys must by law tell the truth in court, even if they're not under oath, according to the State Bar. Or that, under California law, a lawyer who tells a half-truth in court or in court filings is considered to have told an outright lie. Under state attorney ethical standards, an attorney who withholds or conceals material facts or information from a judge also is guilty of lying, according to the State Bar

Larscheid, Buchanan & Zeff family law attorney Timothy Zeff requested and was granted an unlawful $920 child support order by Judge Matthew J. Gary. Zeff's partner, Scott Buchanan, is a family court judge pro tem. The order financially devastated 52-year-old disabled, single parent Susan Ferris. Evicted from her Sacramento home and now homeless, she sleeps on the couch of a Bay Area friend.
SACRAMENTO FAMILY COURT NEWS SPECIAL REPORT

The disturbing aftermath of an unconscionable $920 child support order issued by Judge Matthew J. Gary shows one of the ramifications, and the inexorable human cost of what court watchdogs contend is unchecked family court corruption and cronyism. The April, 2012 order gutted the monthly disability income of disabled, unrepresented, financially disadvantaged family court litigant Susan Ferris from $1,256 to $336. Gary previously issued an equally unlawful order prohibiting the 52-year-old single parent from having any contact with her daughter, Megan.

The April support order financially devastated Ferris, leaving her with far less income than she needed for food, utilities, and rent. After several months under the order and behind on her rent, Ferris was evicted from her East Sacramento home and became homeless. The same court order records that her ex-husband, David Ferris, earns $8,089 per month. Click here to view Gary's minute order, obtained and posted online exclusively by Sacramento Family Court News. As a result of the order, Susan Ferris' credit has been thrashed, the repo man came for her car, and the eviction will now be part of her renter's report, making it virtually impossible for her to rent a home in the future.

Sacramento Family Court reform advocates say the tattered flag that flies above the courthouse is emblematic of the systemic rule of law breakdown - including serial conflict of interest disclosure violations - which they assert has taken place in court proceedings.

Judges Fail To Make Conflict Disclosures: Systemic Legal Error Taints Countless Cases

In hundreds of cases,
Sacramento Family Court judges have failed to make critical conflict of interest disclosures required by state law and the Code of Judicial Ethics, according to a courthouse whistleblower

The disclosure omission is ongoing and infects additional cases each week. The legitimacy of orders and judgments in cases tainted by the error are subject to challenge by trial court set-aside motions or costly appellate court review.

In most of the cases, one party is unrepresented and indigent - substantially reducing the chances that relief will be sought, but nonetheless requiring taxpayers to foot the bill in the event of subsequent proceedings due to the error. The potential public financial liability is significant. The current cost to taxpayers for a single appeal is between $8,500 and $25,500, according to recent appellate court decisions.

New court records leaked by a whistleblower and posted online exclusively by Sacramento Family Court News, including a conflict of interest disclosure filed by a civil court judge, and another filed by a federal judge, show that other Sacramento County Superior Court judges - and federal judges - do comply with conflict laws.
