JUDGE THADD BLIZZARD: Judge with Priors for Ignoring State Law Ignores New State Law
Sacramento County Judge Thadd Blizzard, who ignored state law and effectively aided and abetted a child abduction when he was assigned to family court, is once again issuing decisions that are contrary to law, according to court watchdogs.
The Davis Vanguard reports that Blizzard claims to have found a loophole to allow him to disregard a new state law that provides for a pretrial diversion program for most misdemeanor DUI cases.
One of the exclusions is not misdemeanor DUI. Attorneys in Sacramento note that Judge Thadd A. Blizzard has pointed to a decades-old vehicle code provision to deny diversion for misdemeanor DUI cases.
One attorney described his client as a perfect candidate, with no record and a good job, impressive references, and a blood alcohol level barely over the legal limit who was pulled over for an equipment violation. In this case, the attorney and client went to the DMV and challenged the license suspension, based on evidence that he was not driving with a blood alcohol level of .08 percent or higher.
Still, Judge Blizzard pointed to an old vehicle code provision under section 23640 that says a person can’t enroll or participate in a treatment program to put their case on hold and eventually have the case dismissed.

Identify Judge Misconduct Using the California Judicial Conduct Handbook: News You Can Use

If you believe you are a victim of judge misconduct, before you make a complaint to the CJP use the California Judicial Conduct Handbook to identify what the misconduct is called and the terminology used to describe it. This will significantly increase the odds that your CJP complaint will succeed.

VIRAL VIDEO: Bay Area Family Court Private Judge Threatens Reporters, Refuses Access To Court Records

"One nurse, several dogs, slammed doors and calls for police and security over private judge records. Private judges are lawyers or retired public court judges who are privately paid. We have been seeking access to their records under California Rules of Court 2.400 and state and federal open proceeding laws. Links to those laws can be found here."
The private judge in this video is Gilroy attorney Richard P. Roggia, State Bar #54430. California Judicial Branch whistleblowers allege that the superior courts are being privatized, with private sector, for-profit judges taking over many of the functions of public judges.
The Second District Court of Appeal has criticized the practice of using for-profit private or temporary judges to privatize the courts:
Judge James T. Ford of the Sacramento County Superior Court wrote that privately compensating temporary judging was probably criminal. "Penal Code section 94 bars judicial officers from accepting gratuities for performing public acts. Judges pro tempore [i.e., temporary judges] have identical powers as sitting judges, and their decisions are those of the court without any further intervention by sitting judges. Accordingly, they must be deemed judicial officers within the meaning of the section."
Judge Ford also wrote that privately compensating temporary judges was unethical under the California Code of Judicial Ethics...
Judge Ford wrote: "While clearly not adopted with this recent phenomenon in mind, the Code stands for an important principle: justice and money do not mix. Judging is not in any way a private function; it is a quintessential public function, and should be administered without regard to compensation of the judge." Judge Ford concluded by asking the Judicial Council not to authorize privately compensated temporary judges: "I urge the judiciary to recognize that privately compensating judges pro tempore is illegal and pernicious. We are not for sale, nor is the product of our labor."

16-YEAR RUN OF SERIAL MISCONDUCT BY CONTRA COSTA COUNTY JUDGE BRUCE MILLS BLAMED ON CODE OF SILENCE, COVER UPS BY COLLEAGUES
The CJP is the controversial state agency responsible for investigating complaints of judicial misconduct and for disciplining judges.
From the East Bay Times Report:
MARTINEZ — A Contra Costa judge with a history of ethics violations was charged with judicial misconduct that could warrant his removal from the bench, records obtained Tuesday show.
The two counts of misconduct include allegations that Judge Bruce C. Mills illegally doubled the sentence of a judicial rights advocate who Mills had found to be in contempt of court. Mills jailed the man for discussing his divorce online, a decision that First Amendment experts called, “outrageous” and a free speech violation.
Mills has an apparently unprecedented five prior misconduct actions against him, bringing his running total to seven separate offenses over 16 years. The first incident occurred in 2001 when Mills refused to appoint an attorney for a criminal defendant, and "made comments that disparaged the defendant's version of the case and fostered the appearance that the judge was attempting to pressure the defendant into pleading guilty," according to the CJP.

| Sacramento County Superior Court watchdogs assert that Judge Matthew Gary is under investigation by the Commission on Judicial Performance and California State Auditor for ordering the illegal imprisonment of self-represented court users. In a similar case, Contra Costa County Judge Bruce Mills recently was charged with ethics violations by the CJP. Gary reportedly has delayed his own day of reckoning with help from 3rd District Court of Appeal Presiding Justice Vance Raye, who has intervened to cover for Gary in the appellate court. |
